Terms and Conditions – testhim andrology clinical services (a division of Testhim Limited) (“testhim ACS”) in partnership with LogixX Fertility
1. Introduction and Acceptance
By scheduling an appointment, providing a sample, or using the services of testhim ACS, you agree to be bound by these Terms and Conditions.
2. Services Provided
LogixX Fertility provides a range of andrology related tests on behalf of testhim ACS. These services are for diagnostic purposes only and do not constitute fertility treatment.
3. Medical Information and consent
3.1 Informed consent
You acknowledge that you have been informed about the nature of the tests, their purpose, potential risks, and limitations. You consent to the collection and analysis of your sample.
3.2 Medical advice disclaimer
testhim ACS’ diagnostic services and consultations do not replace comprehensive medical care. Results should be discussed with your physician or fertility specialist for treatment decisions.
4. Sample collection and testing
4.1 Collection requirements
- Samples must be collected according to provided instructions
- You must observe the recommended abstinence period
- Samples may be collected on-site in our private collection rooms or at home (if delivered within specified time frames)
4.2 Sample handling
- Samples must be delivered to the laboratory within the specified time window
- Fitzrovia hospital (the Clinic) is not responsible for compromised samples due to improper collection, storage, or delayed delivery
4.3 Testing process
- Results will be provided through secure methods only
- Repeat testing may be recommended for abnormal results
5. Privacy and confidentiality
These terms and conditions are additional to the Privacy Notice on the Testhim Limited website available here
5.1. What we do with your information
- testhim ACS handles all health care records in line with laws on data protection and confidentiality, including the GDPR and the common law on confidentiality.
- testhim ACS shares health care records with those who are involved in providing you with care and treatment including LogixX Fertility and the Clinic.
- testhim ACS routinely analyses its patients’ records (known as service evaluation or clinical audit) to ensure that the care we provide is guided by the best available scientific evidence. We may work with experts within other appropriate institutions to analyse your data. In these circumstances all participants in the data analysis will be bound by the same confidentiality laws as your clinical team.
- testhim ACS may also carry out research to improve its services, to understand more about the factors affecting male fertility, or to trial new therapies. Your consent will be explicitly sought for any research project involving personally identifiable data.
- testhim ACS share information when the law requires it to do so, for example, to prevent infectious diseases from spreading or to check the care being provided to you is safe.
- Data will be held no longer than necessary and in keeping with standard clinical practices on data retention.
5.2 Results disclosure
Results will only be released to:
- The patient directly
- Authorised healthcare providers with your written consent
- Legal authorities when required by law
6. Fees and payment
6.1 Service fees
- All fees must be paid at the time of booking a service unless prior arrangements have been made
- Current fee schedules are available upon request
- Fees are subject to change with 30 days' notice
6.2 Insurance and reimbursement
- testhim ACS does not accept or bill insurance directly. All services must be paid in full at the time of booking your service.
- We will provide necessary documentation for insurance claims, but cannot guarantee reimbursement
6.3 Cancellation and refunds
- Appointments cancelled with less than 72 hours' notice may incur a cancellation fee
- Fees for collected samples are non-refundable
- Refunds for services not rendered will be processed within 7 working days
7. Limitations and disclaimers
7.1 Test limitations
- Semen analysis results can vary between samples and over time
- Results represent the specific sample provided on the date of collection
- Normal results do not guarantee fertility
- Abnormal results do not necessarily indicate infertility
- Testing has inherent limitations and may not detect all conditions
- For post vasectomy patients, if you are testing after a vasectomy procedure, please understand that our testing only reports the presence or absence of sperm in the specific sample provided on the date of collection. Vasectomy effectiveness can change over time, and the clinic is not responsible if sperm is found in future samples after an initial azoospermic (no sperm) result. Your treating clinician is responsible to authorise that your vasectomy has been considered successful.
7.2 No guarantees
testhim ACS’, Testhim Ltd’s, the Clinic and LogixX Fertility (together “testhim”) do not guarantee:
- Specific test outcomes
- That testhim services will meet your particular needs
8. Liability
8.1 Limitation of liability
To the fullest extent permitted by law, the testhim’s liability is limited to the fees paid for services rendered. testhim is not liable for:
- Indirect, incidental, or consequential damages
- Decisions made based on test results
- Outcomes of subsequent fertility treatments
- Technical failures or delays beyond their control
8.2 Indemnification
You agree to indemnify and hold harmless testhim, its staff, and affiliates from claims arising from your misuse of services or violation of these terms.
9. Specimen storage and disposal
9.1 Retention period
Samples are typically analysed and disposed of within 2 days (if sperm DNA fragmentation testing is performed, spare vial is disposed of after 30 days) except under the following circumstances:
- testhim ACS retains a small proportion of samples for a short period for use in staff training and quality control purposes – e.g. to ensure consistent calibration of equipment over time
- All such samples will be fully anonymised and untraceable to you
- No sample will be retained for more than 3 months
- If you have ordered additional tests on your sample (e.g. sperm DNA fragmentation testing)
- In this case please refer to the individual information documents for the tests concerned
- If you have requested and arranged extended storage for your sample
- In this case refer to the sample storage agreement
- If you have given consent for the remains of your sample to be used for research purposes
- We carry out research using donor samples to improve the services we provide – e.g. in the development of new tests of sperm function
- You will have the opportunity to give or withhold consent for this when you provide your sample
9.2 Disposal
All biological materials are disposed of in accordance with medical waste regulations and cannot be returned.
10. Appointments and scheduling
- Appointments should be scheduled in advance
- You must arrive on time; late arrivals may need to reschedule
- We reserve the right to reschedule appointments due to unforeseen circumstances
- You will be notified of any changes as soon as possible
11. Age requirements
Services are provided only to individuals 18 years of age or older.
12. Termination of services
testhim ACS reserves the right to refuse or discontinue services to any patient who:
- Provides false information
- Behaves inappropriately toward staff
- Fails to comply with clinic policies
- Has outstanding unpaid balances
13. Changes to terms
Testhim reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted with a new effective date. Continued use of our services constitutes acceptance of modified terms.
